Provisional Safeguard Duty FAQ

A guide for our Toyota customers.

In view of the dismissal of the petition for general safeguard measures on the importation of motor vehicles, Toyota is pleased to announce that it will return to its customers the security deposits that have been imposed and previously collected from its sales of motor vehicles. Furthermore, collection of security deposits from new sales will be discontinued.

Toyota dealers will contact the concerned customers regarding the schedules for claiming of refunds.

FREQUENTLY ASKED QUESTIONS (August 2021):

1. What is the status of the provisional safeguard duty?

  •  The petition for the general safeguard measure on imported vehicles has been dismissed.
  •  The Philippine Tariff Commission (TC) has terminated the formal investigation and recommended not to impose definitive general safeguard measures on the products that were the subject of the investigation.

2. How will customers benefit from the termination of the TC’s investigation?

  • All cash bonds that have been imposed and previously collected on importation of motor vehicles shall be returned to the importers.
  • Therefore, security deposit collected from customers based on such imposition will be refunded.
  • Furthermore, collection of security deposits from new sales will be discontinued.

3. How soon can customers get their refunds?

  • Refunds of security deposit will commence as soon as possible.
  • For areas under ECQ or MECQ, claiming schedule may vary due to mobility restrictions.
  • Concerned customers will be contacted and guided by their respective dealers on the specific details.

4. What is the refund mechanism of Toyota Dealers?

  • The customer must show proof of security deposit made to the dealer. The original copy of the Acknowledgment Receipt issued by the dealer must be presented.
  • The security deposit will be refunded through cheque, bank transfer or other methods available at the dealer. Concerned customers will be contacted and guided by their respective dealers on the refund process.

1. What is the Provisional Safeguard Duty on imported vehicles?

  • The provisional safeguard duty is an import duty on certain imported vehicles imposed by the Bureau of Customs (BOC) effective February 1, 2021, as per DTI department Administrative Order (DAO) No. 20-11. 
  • The import duty is "provisional" because this may or may not be returned by BOC depending on the outcome of the investigation by the Tariff Commission. 

2. What are the Provisional Safeguard Duty Rates imposed by BOC?

EXEMPT MODELS:

Vios, Innova, Prius, Supra, Camry V, Fortuner LTD and Q, Prado, Hiace, Alphard, Coaster

5. Will the provisional Safeguard Duty increase the current SRP?

  • The provisional safeguard duty will not increase the current SRP.  However, a security deposit will be collected upon every motor vehicle purchase covered by DAO 20-11 starting March 1, 2021.
  • The security deposit will be returned to the customer in case the Tariff Commission decides (within 120 days indicative timeline) that there is no basis to impose safeguard duties.

  • The security deposit will be collected simultaneously with the down payment. The amount collected will be held in trust for the customer and an Acknowledgment Receipt will be issued.
